These Terms of Use govern your use of orthmanconveying.com (the “Site”), operated by Orthman Conveying Systems, LLC (“Orthman,” “we,” “us”), 650 W Industrial Blvd, Cleburne, Texas 76033. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. Purpose of the Site
The Site describes Orthman’s bulk material handling equipment and contract manufacturing services and lets you request information or a quotation. Product descriptions, specifications, capacities, drawings and photographs are provided for general reference only. Equipment is engineered to order, and specifications may change without notice. Nothing on the Site is an offer to sell. A quotation issued by Orthman, and any resulting order, are governed by Orthman’s Standard Terms & Conditions, not by these Terms of Use.
2. Permitted use
You may view, download and print Site content for your own business evaluation of Orthman’s products and services. You may not copy, republish, scrape, frame or redistribute Site content for any other purpose without our written permission; use the Site in a way that could damage, disable or overburden it; attempt to gain unauthorized access to any part of the Site or its systems; use automated tools to submit forms; or submit false, misleading or infringing content.
3. Intellectual property
The Site and its content, including text, drawings, photographs, videos, logos, product names and page design, are owned by Orthman or its licensors and protected by U.S. and international copyright and trademark law. “Orthman” and the Orthman logo are trademarks of Orthman Conveying Systems, LLC or its affiliates. Other names appearing on the Site belong to their respective owners.
4. Information you submit
When you submit a form on the Site (for example a contact request, quote request or equipment data sheet), you confirm the information is accurate and that you are authorized to provide it. Our use of that information is described in our Privacy Policy. A form submission is a request for information; it does not create an order or a contract.
5. Third-party links and content
The Site may link to or embed content from third parties, such as videos, maps, customer reviews and social media. We do not control and are not responsible for those sites or services, and a link is not an endorsement. Your use of them is subject to their own terms and privacy policies.
6. Disclaimer of warranties
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Orthman disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Site will be accurate, uninterrupted or free of errors or harmful components. Warranties for equipment purchased from Orthman are stated in the applicable quotation and Standard Terms & Conditions, not on the Site.
7. Limitation of liability
To the fullest extent permitted by law, Orthman and its officers, employees and agents will not be liable for any indirect, incidental, consequential, special or punitive damages, or for lost profits, revenue or data, arising from your use of or inability to use the Site, even if advised of the possibility. Orthman’s total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
8. Indemnification
You agree to indemnify and hold Orthman harmless from any claim, loss or expense, including reasonable attorneys’ fees, arising from your breach of these Terms or your misuse of the Site.
9. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute relating to the Site will be brought exclusively in the state or federal courts located in Johnson County, Texas, and you consent to their jurisdiction.
10. Changes
We may update these Terms at any time by posting a revised version with a new effective date. Your continued use of the Site after a change means you accept the revised Terms.
